Post divorce custody battle. What are my odds? - 2007/08/28 14:36 My x and I mediated almost 2 years ago. After coming to an agreement which took about 9 months my x refused to sign the divorce papers. SO I filed them and got the divorce finalized anyway.

Right after that my x got an attorney and sued me for more money. I was already paying her double the "required" alimony out of the kindness of my heart.

My x has since gone hell bent for ruining me financially by dragging me through the courts and trying to initiate kids expenses which she asks I cover, like braces, medical, expensive clothes etc...

My x has been ordered by the court to not contact me as she has subjected me to hours of verbal abuse and also done so in front of the children.

SO in court I decided to go for full custody and the court allowed my atty's request for a custody evaluator. Months into the evaluation my x and her attorney said they didn't approve the evaluator and my x is dragging me back to court for this again. She knows it costs me a lot of money in atty fees and I also have to pay for the evaluation. She just laughs and says hahaha I hope you go broke.

I have HOURS of video and audio tapes of her abusing me and talking her abuse about me with and THROUGH the kids.

Given this behavior, is this enough for the court to award me custody? I hear stories of mothers who are on drugs or are prostitutes and they still seem to be awarded custody over the father.

What are my odds? I'm out of money now to continue this fight and I can't fight a financial battle which I won't win.

What are my odds? - 2008/03/10 17:13 i think it is ludicrous that a parent has to go through a custody evaluation. first off ,you are wanting custody and feel you are a fit parent. why should you prove yourself as a fit parent to the court when you are willing and able to provide for the kid? why is it that the mother "automatically" gets to be the custodial parent. it is evident that her intentions are to destroy you financially and not focused on what is best for the child. unfortunately, our laws do not protect the father very well and we are left financially beaten with court proceedings and evaluations leading to feelings of inferiority.
