Visitation taken out of Nothing - 2008/02/28 02:55 My X and I have been Divorced for a while now and during which I was granted standard visitation with my Two son's. We all know what that is (which is not fair to anyone) every other weekend within 100 miles residence (give or take some) and one month out of the year when living outside of the 100 mile area. Out of what she says is the goodness of her heart ( I think it was because she had a hard time with the kids and needed an extra baby sitter, I don't mind at all I got to see the Children) She decided to give up her weekends to me, so for the last 6 1/2 years I have had the children almost EVERY weekend give or take a few for special occasions for both Parties. I once heard that if the custodial Parent set a precedence of visitation then it is likely that visitation can be changed. Things had been going well with the every weekend thing Until I ended up getting strapped financially and was late twice in a row with my child support by 15 days, suddenly out of the blue and after several heated discussions about my being late on child support, My X decided that she needed her weekends back, her excuse was because she felt that she was not spending enough time with the children. Granted the court 7 years ago told her that she got every other weekend and that the kids stay with her during the week and I get to see them on every other weekend. Now after a lot of Frustration and feelings of Major loss of relationship with my children, I ask myself.. is it really true that I might have a case if my X has set precedence, since I had them every weekend for such a long time that I can petition the court for visitation changes???

Re:Visitation taken out of Nothing - 2008/03/10 17:06 i'm not an attorney, but i think it does set a precedent. why should it be that when it's not convenient for the mother to have the kids then she can unload them and then get them back whenever she wants. in this case it sounds like she is taking them back just out of spite since you were behind in c/s. i think it is pretty cowardly how women get away with this. my ex does it to me all the time. just cause she does not get her way on something she uses our son against me by not leting me see him or not picking up the phone when i call. the fact is that the laws are just screwed up for men period. laws that have been inacted long ago and may not be appropriate today.
